NOC from CGWA

Due to the degrading levels of groundwater, the central government has made it mandatory for the industries to take the No Objection Certificate (NOC) to abstract groundwater. If any organization is using ground water without any prior permission from CGWA before March 31, 2019, it may cause a penalty of Rs. 5000 per day. Central Ground Water Authority (CGWA) was constituted under sub-section (3) of Section 3 of the Environment (Protection) Act, 1986 for the purposes of regulation and control of ground water development and management in the country.

Procedure to obtain CGWA NOC

Step 1: Collection of all supporting documents according to the category of ground water abstraction limit

Step 2: Submission of application online on the CGWA web portal

Step 3: Submission of signed hard copy of the application along with all documents and rain water harvesting proposal

Step 4: Issuance of NOC by CGWA


 

The maximum processing time for the NOC is three to ten months. After receiving an NOC for the first time, the NOC needs to be renewed within two years and after that every three to five years depending on the terms & conditions given in the document. If any company or infrastructure or mining projects use ground water without NOC are liable to pay a hefty fine as Environmental Compensation/Damages.
